INTERNATIONAL STUDENTS CODE OF CONDUCT

Introduction

Purpose - DHU respects the freedom of individuals to inquire, study, evaluate, and gain new understanding and maturity and welcome dissent to improve our education quality. However, freedoms cannot be protected or exercised in a university that lack order and stability. Students ofDHU have an obligation to uphold the laws of the larger community of which they are a part.


Membership in the DHU community does not exempt anyone from Shanghai or Chinese laws and regulations, but rather imposes the additional obligation to abide by all of DHU’s regulations. It is the personal responsibility of every member of the campus community not only to protect his/her own rights, but to respect the rights of others, and to behave in a manner conducive to learning and/or living in an educational environment. Therefore, the purpose of the Code of Conduct is to inform the student body of the rules and regulations that are essential to the normal operation of DHU.


Definition of Student - For the purpose of application of this Code of Conduct, “student” means any person enrolled at DHU, which includes the full-time students & part-time students,and any person who resides in DHU on-campus housing facilities. Persons who are not officially enrolled for a particular term but who have a continuing relationship with DHU are considered “students.” Students who violate the Code of Conduct can expect prompt and deliberate adjudication, whether or not they choose to be present, or remain at the University. Furthermore, if a decision has been made within the disciplinary process which impacts a person who is not currently enrolled, he/she still remains subject to the determination upon re-enrollment.


Students' Rights and Responsibilities - By enrolling at DHU, a student accepts responsibility for compliance with all Shanghai and Chinese laws and regulations, and DHU regulations. A student alleged to have engaged in any misconduct shall have the right of due process and appeal as delineated in this Code. This is not a criminal process, and DHU is not bound by the rules of evidence normally used in cases brought before the Shanghai & Chinese judicial systems. DHU expects all students to show respect for the rights of others and for authority, to protect private and public property, to execute contractual obligations, and to take responsibility for their own actions and the actions of their guests.


General Code of Conduct

  • Study hard and complete all the course work.

  • Abide by the laws and regulations enacted by Chinese government.

  • Abide by the regulations and rules of Donghua University.

  • Respect the customs and habits of the local people and people from other countries.

  • Respect the faculty and staff of the University.

  • Do physical exercises and pay attention to personal hygiene.

  • Respect your fellow students and be friendly to each other.

  • Maintain and promote the friendship and solidarity between people from different countries.



Administration of Discipline

The responsibility of managing the discipline system for international students is delegated by the President of the University to the Dean of ICES. In turn, he may delegate authority to other groups or individuals for handling violations of the Code of Conduct.

Disciplinary regulations at DHU are set forth in oral or written format in order to give students general notice of prohibited conduct. These rules and regulations should be read broadly and are not designed to define prohibited conduct in exhaustive terms. It is recognized by DHU that students are adults and are expected to obey the law and take personal responsibility for their conduct.


Violation of any municipal ordinance, law or regulation of Shanghai, or law or regulation of China, which may cause harm or endangerment to self or others, or somehow compromises the educational mission of the University, may result in disciplinary action. The University does not normally take disciplinary action for off-campus violations, but it retains the right to act in special cases. Disciplinary action imposed by DHU may precede, and be in addition to, any penalty that might be imposed by an off-campus authority. The procedures to be followed in matters of academic and nonacademic misconduct differ and are outlined in the following sections. When accused of a violation, a student has a right to review the evidence against him or her, but this does not necessarily mean the right to confront a witness.

Academic Misconduct

Any student found guilty of academic misconduct shall be subject todisciplinary action. Academic misconduct includes, but is not limited to, the following actions:

  1. Cheating or assisting another student in committing an act of cheating or other forms of academic dishonesty;

  2. Plagiarism, which includes, but is not necessarily limited to, submitting examinations, themes, reports, drawings, undocumented quotations, computer-processed materials, or other material as one's own work when such work has been prepared by another person or copied from another person. Submit the work prepared for another course without the approval of the instructor will also be considered as plagiarism

  3. Unauthorized possession of examinations, reserve library materials, or other course-related materials;

  4. Unauthorized changing of grades on an exam or a grade report or access to academic computer records;

  5. Nondisclosure or misrepresentation in filling out applications or other University records in, or for, academic departments or colleges.


Academic Discipline Process (General Cases) - For incidents that occur at the course or other level (e.g., falsification of academic records), the faculty member or Academic Affair Officer must inform the student of the alleged offense within ten working days of its discovery, and after an investigation and/or conference, will take one of the following actions:

  1. The allegation may be dismissed as unfounded.

  2. The allegation may be dismissed for lack of clear and convincing evidence;

  3. The student may admit guilt and a sanction will be imposed;

  4. CIP director will determine guilt based on clear and convincing evidenceand a sanction will be imposed.


Appeal Process - A student who wishes to appeal an instructor’s decision may do so by writing to the Grievance Committee through within five (5) working days. Student may appeal the decision of CIP director to one of the deans of ICES. Following points will apply in all cases of appeal:

  1. The appeal must be made in writing to the appropriate personwithin time limit.

  2. The appeal must include the name of the individual making the appeal, the action being appealed, the date the action took place, and the grounds for appeal. Appeals must be made based on at least one of the following grounds:

    1. Procedural of prejudicial error was committed.

    2. The finding of facts in the decision is inaccurate.

    3. Reasons why evidence should not be considered must be stated.

    4. Reasons why the sanction imposed is excessive or inappropriate.

  3. The highest level of appeal for academic misconduct is the dean of ICES.


Non-Academic Misconduct

The following list constitutes violations for which students are subject to disciplinary action. This list is not designed to be all-inclusive, but offers examples of the types of prohibited conduct.

  1. Actual or threatened physical injury to any person (including self) on campus, or conduct that endangers the health or safety of a person.

  2. Engaging in individual or group conduct that is violent (including sexual misconduct, attempted suicide, or threats of either), abusive indecent, unreasonably loud, or similar disorderly conduct that infringes upon the privacy, rights, or privileges of others or disturbs the peace or the orderly process of education on campus.

  3. Engaging in vandalizing DHU or other individual’s property (e.g. damaging furniture, defacing walls and notices).

  4. Unauthorized use, possession, or storage of any weapon or explosive (including fireworks) on DHU premises or at DHU sponsored activities.

  5. Forgery, counterfeiting, alteration, or misuse of any University record, document, or identification card of a non-academic nature (e.g., apartment applications or classroom usage permits).

  6. Unauthorized entry into or alteration of any University computer records.

  7. Reporting the presence of a fire, bomb, explosive or incendiary device on campus without good reason to believe the facts reported are true.

  8. Unlawful possession, use, distribution, or sale of any narcotic or dangerous drug as defined by Shanghai and/or Chinese government

  9. Theft of, or unwarranted damage to, University property or property of any member of the University community.

  10. Failure to comply with apartment regulations.

  11. Entry into, or use of, any building, facility, or room, or other University property or grounds without authorized approval. This also includes the unauthorized possession or use of University keys or other access codes.

  12. Participation in illegal gambling activities on University.

  13. Failure to make satisfactory settlement for any debts to the University.

  14. Failure to comply with University traffic rules and regulations.


Non-academic Discipline Process - All alleged violations of non-academic rules and regulations contained herein will be referred to CIP director or Vice Dean of ICES in charge. The following procedures will apply:


The school may consider any documentation submitted, including but not limited to Police or other University reports, and may choose to interview persons who might have information relevant to the case. The student accused of violating the Code of Conduct is responsible for providing any information that would be helpful in supporting a finding of Not Responsible for the alleged violation. The school will make a reasonable attempt to obtain all relevant information. As a result of an investigation and/or conference with a student or organization representative, one of the following actions may be taken:

    1. The allegation may be dismissed as unfounded;

    2. The allegation may be dismissed for lack of evidence;

    3. The student may admit guilt and a sanction will be imposed,

    4. The director will determine guilt, based on a preponderance of the evidence, and a sanction will be imposed.


Appeal Process- The appeal must be made in writing to the appropriate person within three (3) working days after notification of the decision.The following points will apply in all cases of appeal:

  1. It must include the name of the individual making the appeal, the action being appealed, the date the action took place, and the grounds for appeal. Appeals must be made based on at least one of the following grounds:

    1. Procedural of prejudicial error was committed.

    2. The finding of facts in the decision is inaccurate.

    3. Reasons why evidence should not be considered must be stated.

    4. Reason why the evidence was not offered during the hearing must be stated.

    5. Reasons why the sanction imposed is excessive or inappropriate.

  2. Upon review of an appeal, the appellate person may uphold, modify, or completely reverse the original decision.

  3. The highest level of appeal for nonacademic misconduct is Vice Dean of ICES in charge.



Disciplinary Procedures for International Students of Donghua University


Chapter 1: General Principles


Clause 1 The Procedures are made in accordance with the Higher Education Law of the People’s Republic of China, the Law of the People's Republic of China on Control of the Entry and Exit of Aliens, the Regulations on Acceptance and Culture of International Students in the University, the Disciplinary Procedures for International Students of Donghua University, in combination of practical culture situation of international students in the university.


Clause 2 The Procedures are applicable to the full-time students with academic education, who are duly registered in the university and who have a foreign nationality, as well as those exchange students who are dispatched by foreign institutions and admitted for studying in the university.


Clause 3 The disciplinary actions include a warning, a serious warning, recording a demerit, being kept in school but placed under surveillance, and expulsion from academic status.


Charter 2: Disciplinary Action and Punishment


Clause 4 The international student who has committed one of the following actions will be expelled from academic status.


  1. Violating the laws of China, constituting a criminal offence;

  2. Having security administration punishment under serious circumstances, causing serious consequences;

  3. Substituting others or allowing others to take the test for them, organizing the cheating, cheating by means of communication equipment or other equipment, selling test questions or answers to others for profitable purposes, and other serious acts of cheating or acts disrupting the examination order;

  4. Plagiarism, falsification, and forgery in dissertations and publicly published research results, or purchasing or selling paper writing services;

  5. Seriously disturbing the public order, living order and administration order in public places in the university;

  6. Infringing on the legitimate rights and interests of other individuals and organizations, causing serious consequences;

  7. Violating the university regulations frequently and refusing to change after education.


Clause 5 The international students who has one of the following acts will be kept in school but placed under surveillance, the second probation level.

  1. Unexplained absenteeism, up to 54 academic hours and above in a semester, but not meeting the dropout criteria;

  2. Cheating when taking the test (examination), including peeking at relevant materials during the test, passing or exchanging test papers, using equipment with sending or receiving functions, intentionally damaging the test paper, etc or having other equivalent behaviors;

  3. Failing to purchase insurance in accordance with state regulations;

  4. Having any public security administration punishment.


Clause 6 The international students who have one of the following acts will be recorded a demerit, the first probation level.

  1. Unexplained absenteeism, accumulatively over 48 academic hours but less than 54 academic hours in a semester;

  2. Cheating when taking the test (examination), including carrying relevant materials, passing notes, peeking, whispering or having other equivalent behaviors during the examination;

  3. Providing false materials and defrauding various scholarships and medical insurance premiums.


Clause 7 The international students who have one of the following acts will be given a serious warning.

  1. Unexplained absenteeism, accumulativelyover 32 academic hours and less than 48 academic hours in one semester;

  2. Cheating when taking the test (examination), including self-prepared draft paper in the test, self-borrowing test tools, carrying equipment with sending or receiving functions, continuing to answer questions before or after the test, taking the test papers and other materials out of the examination room or having other equivalent behaviors;

  3. Disrespecting others and performing badly;

  4. Engaging in religious activities such as having missions and participating in religious gatherings on campus;

  5. Damaging the public property deliberately and failing to compensate for the loss at the price;

  6. Driving motor vehicles illegally on campus, without listening to dissuasion;

  7. Participating in the fight directly or organizing other people to fight, or planning a fight;

  8. Having any employment during the period of study, participating in an internship, business, or other commercial activities without permission for an internship visa.


Clause 8 The international students who have one of the following acts will receive a warning.

  1. Unexplained absenteeism, a total of 16 academic hours or more and less than 32 academic hours in one semester;

  2. Violating the examination room disciplines when taking the test, including entering the examination room without carrying a valid ID card, not putting the schoolbag book at the designated place, not sitting at the designated seat, playing in the prohibited area of the examination room, leaving the examination room without consent or authorization or having other equivalent behaviors;

  3. Having an expired visa or Residence Permit;

  4. Failing to comply with apartment administration rules, violating visitor management regulations, influencing others' rest in the apartment in various ways, using electrical appliances or fire in an illegal manner in the room, failing to throw rubbish by classification as per the rules, and smoking inside the apartment building;

  5. Failing to abide by the administration regulations for teaching buildings, having dinner in the classroom, making a racket and disturbing the teaching order, breaking in other classrooms arbitrarily, failing to throw rubbish by classification as per the rules, and smoking inside the teaching buildings;

  6. Being in arrears of school tuition or accommodation fees;

  7. Living out of campus but failing to report to the school and the public security bureau for registration the latest accommodation address within the prescribed period;

  8. Having any other improper behaviors.



Charter 3 Disposal and Execution of Disciplinary Action


Clause 9 The International Cultural Exchange School is the educational administration bureau for international students of the university, which will, directly, issue the notice of a warning, a serious warning, being recorded a demerit and being kept in school but placed under surveillance, as an administration sector, with the signature of international students in person for confirmation. The expulsion from academic status shall be subject to the punishment opinions out of the party-government conference held by the International Cultural Exchange School, which shall be submitted to the university for a final review and decision.

Before making a disciplinary decision against the student, the university informs the student of the facts, reasons and basis for the decision, as well as the right thereof to make representations and defenses, while listening to the student's statement and defense.


Clause 10 A disciplinary decision shall be issued in the event of any punishment against the student, including the following details.

  1. Basic information of the student;

  2. Facts and evidence for the punishment and how the School came to the decision;

  3. The type, basis and time limit of the punishment;

  4. Methods and deadlines for appeals;

  5. Other necessary contents.


Clause 11 Those international student subject to punishment will be deprived of all the scholarship and reward evaluation qualifications in the school year, and the punishment shall be recorded in the individual overseas study file of the student.

Clause 12 As for the student with scholarship who is subject to the punishment of a serious warning and more, the university will deliver the written disciplinary decision to the organization offering the scholarship.


Clause 13 The international student who is dismissed from school shall go through the formalities of leaving school within 15 working days after the university makes the decision. For those who fail to do so, the school will report to the government authority for mandatory cancellation of their study visa.


Clause 14 If an international student is expelled from school, the school will no longer accept the registration application of the student.


Clause 15 The punishment shall be valid for 12 months, except the disposal of expulsion from academic status, when the student may raise an application before the expiration and the administration sector of the university will rescind after discussion and making a decision.


Chapter 4 Student Appeal


Clause 16 The international student may, within 10 days from the date of receiving the disciplinary decision, file a written appeal to the Student Appeal Committee, in accordance with applicable provisions for an appeal of the university, in the event of any objection to the treatment by or the disciplinary decision of the university.


Chapter 5 Supplementary Provisions


Clause 17 All types of international students who come to the university for non-degree education shall also conform to the Procedures.

Clause 18 These Provisions were reviewed and approved by the Principal Office Meeting on July 8, 2019, and shall be implemented from September 1, 2019.

Clause 19 The power of interpretation of the Measures is reserved by the Principal Office Meeting, and the International Cultural Exchange School shall be responsible for specific interpretations.

The Second Written Warning - A notice in writing to the student that they are in violation or have violated the code of conduct.

The First Disciplinary Probation - Disciplinary Probation is a written reprimand for violation of University regulations or government laws. Students placed on disciplinary probation are deemed “not in good standing” with the University. The duration of the probationary period, and conditions imposed shall be in proportion to the seriousness of the misconduct. During the probationary period, reported violations of the Code of Conduct or conditions of the probation will result in further action. This action may include, but is not limited to, extension of the probationary period, the addition of other restrictions or conditions to the probationary agreement, suspension, or dismissal. A student may return to a status of “in good standing” at the conclusion of the probationary period, assuming all conditions have been satisfied.

The Second Disciplinary Probation -Disciplinary suspension is the disenrollment of a student from the University. Suspensions will last a minimum of one full semester. Students may reenter the University at the conclusion of the suspension, only by consent of CIP director, in cases of academic and non-academic misconduct. A permanent notation of a Suspension may be made on the student’s transcript.

Expulsion - Expulsion is the disenrollment of a student whereby the student is not eligible for readmission to the University. A permanent notation of expulsion will be placed on the student’s transcript
