Gambling, Smoking and Sexual Misconduct Policies

  

Gambling Policy

Gambling, including online gambling, is illegal and prohibited in China, except Macao. Participating or holding activities related to gambling, including online gambling, will be subject to criminal charge as well as disciplinary action of expulsion from the University and the country. It is also written in Chinese law and a University policy that any student will notify ICES immediately after conviction of a gambling related activity on campus or off campus. If a student fails to report such gambling activity may face the criminal charge as well as disciplinary sanction.

    

  

Smoking Policy

For the health and wellness of DHU students and employees. DHU STRONGLY suggests you not smoking. According to the smoking policy of Shanghai, smoking is prohibited in public areas, especially inside a public building. In DHU, students are prohibited to smoke inside any buildings, including teaching buildings and apartment buildings. Students found smoking inside building will receive disciplinary sanction from Oral Warning to Probations. If it is the smoking that causes any accident, such as fire, the student may be subject to more severe punitive sanctioning including expulsion from the University.

  

Following are non-smoking areas according to Smoking Policy of Shanghai coming into force on March 1st 2010:

1.Indoor & outdoor area of kindergarten, primary school, children’s palace and activity center for the youth;

2.Other educational institutes not mentioned in the article 1, student dormitory, restaurant and other indoor areas;

3.The indoor & outdoor area of hospitals for children & women and welfare center for children;

4.Other indoor areas of hospitals and health agencies not mentioned in the article 3;

5.The audience sectors and competition fields of the stadium

6.The indoor areas of the library, cinema, odium, exhibition ground, museum, art gallery, memorial hall, science & technology center, archives and other public culture places

7.Government service areas

8.Business office for public utility & financial institutes

9.Markets, supermarkets and other commercial areas

10.Elevator & its waiting area

11.Bus, taxi, train, subway, light rail, ship and other public transportation and its ticket office, waiting and the indoor station;

12.Internet bars and any other place provide internet access.

13.Other areas prescribed by law

Any individuals who smoking in above areas and ignore the warning may be fined ranging from CNY 50 to CNY 200.

  

Electronic Devices Usage Policy

It is students’ responsibility to keep the classroom order. Electronic devices are not allowed to use in the classroom for the purpose not related to the class. Please turn any devices, especially your mobile phone into “silent” mode or turn it off during classes. Lecturers have the right to confiscate your electronic device in the class if its usage does not related to the class, interrupt the lecture, or disturb the study of other students in class. In addition, using electronic devices during the exam will be treated as cheating. Please turn any electronic devices off, put them in your bag, and put your back in the designated area during the exam.

  

Sexual Misconduct Policy

DHU will not tolerate sexual misconduct of any kind:

  

Forced Sexual Contact - Any harmful, insulting or non-consensual verbal or physical contact of a sexual nature with another person (including touching, fondling, exposure, disrobing, etc.) that is accomplished towards another without his/her consent including any such act accomplished by means of actual or implied force, threat, coercion, or helplessness. Forcing or intimidating a person to touch another's intimate parts shall also constitute sexual contact.

  

Forced Sexual Penetration - Intercourse (vaginal penetration); sodomy (anal penetration); oral copulation (oral-genital contact); or penetration with any object (including a finger), by the use of force, threats, coercion, or by taking advantage of a victim's helplessness.

  

A violation occurs when there is participation in any kind of sexual misconduct by a student individually or in concert with others. Since the University hopes to educate students in order to prevent violations, students should understand that:

  

A.Forced sexual penetration or other unwanted forced sexual contact is defined as sexual misconduct whether the assailant is a stranger or an acquaintance of the victim.

B.Alcohol and/or drug use, intoxication, or any impairment of the accused, does not absolve responsibility for sexual misconduct.

C.In situations where the victim is incapable of giving consent, or is unable to resist sexual advances due to alcohol/drug use or other impairments, the accused will be held responsible for sexual misconduct.

D.Threat is defined as an expression of intention to hurt, destroy, or punish the victim or another.

  

Other sexual misconducts: Any activities associated with prostitution and visiting or establishing pornographic website are also illegal in China. These activities will also be considered as sexual misconducts and any individual involving in these activities will facing the penalty from the government and university authorities.

Where there is cause to believe that the University regulations prohibiting sexual misconduct have been violated, the University will initiate disciplinary action. Accusations of sexual misconduct will be investigated by related University or government authorities. If clear and convincing evidence is available to indicate that a student is guilty of sexual misconduct, or if guilt is admitted, student can be prosecuted under Chinese criminal statutes and disciplined under the Student Code of Conduct. Even if the law enforcement authorities choose not to prosecute, the University can pursue disciplinary action of expulsion. Any student who fails to report the University immediately after conviction of a sexual misconduct on campus or off campus will receive university disciplinary sanction.
